Judge Returns Records to Rush Limbaugh

In an apparent legal victory for top talk radio host Rush Limbaugh, Florida Circuit Court Judge Thomas Barkdull has returned most of his medical records to his attorney, Roy Black - thereby denying prosecutors "free rein" over Limbaugh medical file.

Late Wednesday afternoon, Black issued the following statement:
"I am confident that the State Attorney will find nothing in these records to support a charge of doctor shopping, because there was no doctor shopping. The records show that Mr. Limbaugh received legitimate medical treatment for legitimate medical reasons.

"We are grateful to Judge Barkdull for providing the review of the records for relevancy that we requested. Most of the records were returned to me today, and were not given to the prosecutors. This proves our point that the State's wholesale seizure of Mr. Limbaugh's medical records was improper.

Looks like he wasn't " doctor shopping " after all.
Wonder if they will continue on with a trial/

Interesting. The local papers hail it as a victory for the prosecution.

In a prepared statement, (Assistant State Attorney James) Martz said the investigation has been stalled long enough. "After the review of this office's use of a search warrant by five separate courts, including the 4th DCA (District Court of Appeal) and the Florida Supreme Court ..... the review of those records now goes forward in earnest, despite the many efforts to derail the investigation over the past 19 months," Martz said.

Here is the Palm Beach Post's version of the story (the paper usually cited by Mr. Limbaugh on his website) - a little more neutral.
