JULY 18, 2005 -- The mother of two small children is in critical condition and her husband is dead after an accident involving a drunk driver.
Phillip Gardner of Mount Holly was killed when a drunk driver hit his car on Highway 130 near the Brunswick/Columbus county line Saturday.
Gardner, his wife, and two children were on their way to the beach for a vacation.
The driver of the truck, Ramiro Gallegos, is charged with DWI and 2nd degree murder.
At last check, Gardner's wife was in the hospital in critical condition. The two children were treated and released. Authorities say their child safety seats saved their lives.

AUGUST 1, 2005 -- An illegal immigrant accused in a drunk driving death is one step closer to trial.
A grand jury has indicted Ramiro Gallegos from Supply, on a charge of 2nd degree murder.
Gallegos is accused of causing a wreck that killed Scott Gardner, a teacher from Gaston County on vacation in the area.
His wife, Tina Gardner, is still in critical condition at the hospital. Their two young children were not seriously injured.
Gallegos has already been convicted twice of driving while impaired. He is in the Brunswick County jail.

We dug a little deeper into Ramiro Gallegos's background and found this is his fourth DWI. Next we wanted to find out how it's possible for an illegal alien who has gone through the court system several times to still be here in the United States.
As well as the DWIs, authorities also caught him driving without a license several times. Even so, he still remained on the streets illegally. Armed with this information, we went to Immigration Attorney Al Cook to get to the bottom of things.
"That's not the kind of crime that raises itself for deportation. If an illegal alien is arrested for DWI, the statute doesn't provide that would cause deportation," said Cook.
In other words, Ramiro Gallego's DWI convictions do not fall under the list of crimes considered deportable. To be deported, an illegal alien has to be convicted of crimes like rape, robbery, arson or murder. There's also the fact that the federal government handles deportation, not local authorities.
"The state government, county prosecutors ... would have no authority once he was arrested and convicted of DUI to send him back to his country," added Cook.
If Gallegos is convicted of second degree murder in the death of Scott Gardner, he will be deported after he serves his sentence here. Of course, that time served will do nothing to bring back the father of two young children. Once someone is deported, they cannot return to the United States. If they do, that's considered a felony. If they're caught, they'd likely serve more time here and then get deported once again.
My Comments:
I love the Immigration Attorney's answer . . . just because someone is here illegally, doesn't mean he's done anything illegal to be deported.
Personally I don't care if the "kind of crime that raises itself for deportation" has been met . . . the fact that someone is here illegally should warrant an automatic trip back "home" . . . by the slowest and most painful way possible.
"Let's see here, you say you’re from Mexico . . . great we'll be sending back to Mexico . . . via El Salvador. Since you're already familiar with crossing borders illegally, you shouldn't have any problems."
Did we mention . . . while he is being tried the taxpayers are paying for his defense with a court appointed attorney. And once, hopefully, convicted and imprisoned, the taxpayers get to foot that bill to. And to add insult to injury, once he serves his time and is finally deported, the taxpayer gets stuck with that bill too.

When I was a cop in the South Bronx we had a car thief who was arrested and convicted 22 times and the most time he served was 2 months. What the stupid #&%* did was after being released on the 21 time he left the court house and stole a judges car!
This time he got three to five years.
My point is...
Nothing will happen until a tragedy happens to someone in power then all hell will come loose. It's like when these movie stars are stricken with some disease or someone close to them is affected that they become aware of these things and become fighters for a cause.
Sad? Yes.
True? yes.

| We recently had a 2 car accident in front of where I work, The driver of the car that caused it and his passenger were illegal aliens according to the cops on the scene. Both tried to run after one checked to be sure the other driver was alright, my boss caught and held one until the cops showed up. When asked what would happen to them, the authoritys said they would be jailed and would get bail and most likely disappear once released. This is a common practice with illegal aliens. Rather than hold them for the INS and promptly deport them, they get released. Anyone else would spend some time behind bars and get sued into bankruptcy. |

but technically, by definition of their illegalness of their stay, the police can just arrest them.
tresspassing of PRIVATE property. property of individuals who own it individually. or property of the United States government, which implies htat hte individuals own it collectively. |
